Abstract U mjestu Čakovec došlo je do prometne nesreće, pri čemu je motorno vozilo sudjelovalo
u sudaru s psom, odnosno prema riječima tužitelja došlo je do podlijetanja psa pod vozilo te isti
ističe potrebu za nadoknadom štete. Vještačenje je provedeno sedam godina nakon navedenog
događaja, temeljem analize spisa predmeta i relevantnih dokaza. U obzir su uzeti izvještaji
stručnjaka prometno-tehničke struke, obuhvaćajući aspekte poput mase vozila, naletne brzine
vozila, mjesto naleta na životinju na kolniku te način i brzinu kretanja životinje u trenutku
naleta. Dodatno, analizirani su veterinarski nalazi nakon četiri dana od nesreće, gdje je
zaključeno da je pas Bufi bio potpuno klinički zdrav. Cilj vještačenja bio je utvrditi mogućnost
da pas nije zadobio nikakve ozljede nakon prometne nesreće te istražiti vremenski okvir unutar
kojeg bi eventualne ozljede bile vidljive, posebice u slučaju kontakta s motociklom. Nadalje,
bilo je potrebno odrediti težinu psa Bufija u vrijeme nesreće. Nakon temeljite analize svih
relevantnih činjenica, fotografija i vještačenja, zaključeno je da bi pas Bufi vjerojatno zadobio
teške ozljede koje bi ozbiljno ugrozile njegov život. U slučaju preživljavanja, oporavak bi trajao
mjesecima, što implicira da bi vidljivost samih ozljeda bila dugotrajna, mnogo duže od četiri
dana. Nadalje, težina psa u vrijeme prometne nesreće, prema stručnoj procijeni, nije značajno
varirala u odnosu na težinu utvrđenu od strane vještaka. Na koncu, sagledavajući sveukupnu
sliku iznesenih činjenica, ne postoji dokaz o direktnom udaru i pregaženju psa od strane
motocikla što ide u prilog tuženiku te je ovakav zaključak poduprt stručnom analizom
prometno-tehničkih stručnjaka i veterinara.
Abstract (english) In the town of Čakovec, a traffic accident occurred involving a motor vehicle colliding
with a dog. According to the plaintiff, the dog was struck by the vehicle, and the plaintiff asserts
the need for compensation for damages. Expert examination was conducted seven years after
the incident, based on the analysis of case files and relevant evidence. Reports from traffictechnical experts were taken into consideration, encompassing aspects such as vehicle mass,
collision speed, the location of the impact on the animal on the road, and the manner and speed
of the animal's movement at the moment of impact. Additionally, veterinary findings after four
days of the accident were analyzed, concluding that the dog Bufi was entirely clinically healthy.
The aim of the expert examination was to determine the possibility that the dog did not sustain
any injuries after the traffic accident and to explore the timeframe within which potential
injuries would be visible, particularly in the case of contact with a motorcycle. Furthermore, it
was necessary to ascertain the weight of the dog Bufi at the time of the accident. After a
thorough analysis of all relevant facts, photographs, and expert opinions, it was concluded that
Bufi would likely have suffered severe injuries that would seriously jeopardize his life. In the
event of survival, recovery would take months, implying that the visibility of the injuries would
be prolonged, far beyond four days. Additionally, the dog's weight at the time of the traffic
accident, according to expert assessment, did not significantly deviate from the weight
determined by the examiner. In conclusion, considering the overall picture of the presented
facts, there is no evidence of a direct impact and run-over of the dog by the motorcycle, which
favors the defendant and such a conclusion is supported by the expert analysis of traffictechnical experts and veterinarians.
