Abstract

U radu je uz prikaz nalaza iz sudskog spisa ilegalnog uvoza ovaca uz prikaz
zakonodavne veterinarske legislative koja je bila na „snazi“ u vrijeme pocinjenja
nedozvoljenog uvoza i kasnije. Nije teško zakljuciti da u konkretnom slucaju djelatnici
policijske postaje postupaju ispravno kada pošiljku ilegalno uvezenih ovaca prepuštaju
jednom veterinarskom uredu. Djelatnici veterinarskog ureda izdaju Rješenje o oduzimanju
pošiljke ovaca i provodenju karantene na trošak korisnika uvezenih životinja. U konkretnom
slucaju karantena traje nedopustivo 2 mjeseca, briga o ovcama vlasništvo države prepušta se
bivšim vlasnicima u trajanju od 16 mjeseci nakon cega ovce carinska uprava prodaje trecoj
osobi. U konkretnom slucaju navedeni korisnici kupovali su hranu, vodu, placali veterinarske
usluge, iako se u spisima navodi da su životinje kahekticne, neuhranjene, trebaju biti tretirane
vitaminima i antiparaziticima i sl. te su držane u lošim zoohigijenskim uvjetima. Kolika je
korist od ovaca s ovim osobinama držanim u navedenim uvjetima teško je reci, ali je lako
vidljivo da se ovce ne doje, vec da janjci sisaju mlijeko. Koliko je janjaca rodeno, koliko ih je
uginulo nemoguce je reci jer se vlasnik životinja ne ponaša pažnjom dobra domacina, a koji je
bio odgovoran novorodene životinje oznaciti, a uginule razuditi i upisati u upisnik uginulih
životinja. U konkretnom slucaju ispravno se postupa kada se životinje oduzimaju što se ne
može reci za dužinu trajanja karantene kao i daljnji uzgoj na racun bivših vlasnika. Oduzete
ovce ili je trebalo vratiti, uništiti ili ekonomski iskoristiti.
U konkretnom slucaju trebalo je ovce prodati ili uputiti u klaonicu, a ostvarenu cijenu
koštanja uplatiti u državni proracun.

Abstract (english)

The paper with the presentation of findings from the case file to illegally import of
sheep giving the legislative veterinary legislation, which was to 'force' at the time the illicit
import and later. It is not difficult to conclude that in this case the employees of the police
station to act properly when a shipment of illegally imported sheep are left to one veterinary
office. Staff veterinary office shall issue a decision on the withdrawal of the consignment of
sheep and implementation of quarantine at the expense of users of imported animals. In the
specific case of quarantine lasts unacceptable two months, taking care of the sheep property of
the state is left to the former owners for a period of 16 months after which the sheep customs
administration sold to a third party. In the specific case mentioned people bought food, water,
paying veterinary services, although the scriptures says that animals are cachectic,
malnourished, should be treated with vitamins and vermin, etc., and were kept under poor
hygiene conditions of. What is the benefit of sheep with these characteristics were kept under
these conditions it is difficult to say, but it is easy to see that the sheep do not breastfeed, but
that lambs sucking milk. How many lambs were born, how many have died is impossible to
say because the owner of the animal does not behave with good care of the host, who was in
charge of newborn animals to mark a dead dessected and entered in the register of dead
animals. In this particular case are properly handled when animals consuming what can not be
said for the duration of the quarantine and the further cultivation at the expense of the former
owners. Seized sheep or should have been returned, destroyed or economically exploited.
In this case, the sheep had to be sold or refer to the slaughterhouse, and realized the
cost paid to the state budget.
